Terms of Service

The rules and legal agreements that govern your use of the Heala Health platform.

Welcome to Heala Health. By creating an account or using any part of our service, you agree to be bound by these terms. Please review this document alongside our Privacy Policy, which explains how we protect your data.

If you do not agree with any part of these terms, please do not use the Heala Health platform.

1. About & Who Can Use Heala Health

Heala Health is a Nigerian digital healthcare platform. You must be 18+ (or 13+ with parental consent) and provide accurate registration details to use it.

Heala Health Ltd ("Heala Health", "we", "us", "our") provides a platform that connects patients with licensed medical professionals and helps users manage their personal health information. Our registered office is in Lagos, Nigeria.

You may use Heala Health if you are a resident of Nigeria or accessing the platform from a jurisdiction where our services are lawfully available, and you are not prohibited from receiving our services under applicable law. Each person may only hold one patient account.

2. The Nature of Our Service (Medical Disclaimer)

We are a technology platform, NOT a hospital. The AI provides guidance, not diagnoses. In emergencies, call 112 immediately.

Important Medical Disclaimer: Heala Health is a technology platform. The AI symptom checker provides general health guidance only and does not constitute a medical diagnosis, professional medical advice, or a substitute for consultation with a licensed doctor.

What we provide: A platform connecting patients with independent licensed doctors, an AI-assisted symptom guidance tool, digital storage for health records, and payment processing.

What we DO NOT provide: Medical diagnoses, emergency medical services, or a replacement for in-person medical care where physical examination is necessary. Doctors on the platform are independent licensed professionals verified through the MDCN, not employees of Heala Health.

3. The AI Symptom Checker

The AI is a decision-support tool designed to help you understand your symptoms. It cannot issue prescriptions or make clinical judgements.

You must understand and accept the following:

  • The AI does not diagnose medical conditions and is not a substitute for professional advice.
  • You should always consult a licensed doctor before making decisions about your health.
  • In any situation involving chest pain, difficulty breathing, loss of consciousness, or other potential emergencies, call emergency services immediately.

By using the AI, you agree that Heala Health is not liable for decisions made based on its output.

4. Payments, Subscriptions & Refunds

Doctors set their own consultation fees. Payments are securely processed via Paystack. Refunds are issued for technical failures or doctor no-shows.

Consultation fees are displayed clearly before you confirm a booking. We deduct a platform commission from each fee. Subscription plans are billed monthly in advance and can be cancelled at any time.

Refund Policy:

  • No refund once a consultation has successfully taken place.
  • Full refund if a doctor fails to attend a scheduled consultation.
  • Full refund if a consultation could not proceed due to a platform technical failure.
  • Disputes must be raised within 48 hours at support@healahealth.com.

5. Acceptable Use & Your Content

Do not misuse the platform, provide false health info, or harass others. Doing so will result in immediate account suspension.

You agree NOT to use the platform to:

  • Provide false information or impersonate a medical professional.
  • Harass, threaten, or abuse doctors or other users.
  • Attempt to reverse engineer, hack, or disrupt the platform.
  • Use the AI symptom checker to attempt to obtain controlled substances illicitly.

Deliberately providing false health information to a doctor through our platform may be a criminal offence under Nigerian law.

6. Liability & Intellectual Property

We own the platform technology. We are not legally liable for the clinical decisions made by independent doctors or unforeseen network outages.

All technology, design, software, and trademarks (excluding your personal health data) are owned by Heala Health Ltd. The "Heala Health" brand is our trademark.

To the maximum extent permitted by Nigerian law, Heala Health is not liable for clinical decisions made by independent doctors, harm from relying solely on AI guidance, or service interruptions due to third-party infrastructure. Our maximum liability shall not exceed the total amount you paid to us in the 12 months preceding a claim.

7. Legal, Termination & Disputes

These terms are governed by Nigerian Law (Lagos State). You can close your account at any time. Disputes require a 30-day good faith negotiation.

You may close your account at any time through the app or by emailing support@healahealth.com. We may suspend your account if you breach these Terms.

These Terms are governed by the laws of the Federal Republic of Nigeria. Any disputes shall be subject to the exclusive jurisdiction of the courts of Lagos State. Before initiating legal proceedings, both parties agree to attempt to resolve disputes in good faith for at least 30 days.

8. Waitlist Terms

By joining the waitlist, you agree to receive launch updates. Referral perks are subject to verification to prevent fraud.

By joining the Heala Health waitlist, you agree to receive a confirmation email, our newsletter (which you can opt out of), and launch notifications.

Any free consultation credits offered to waitlist members are subject to availability, valid for 90 days from account creation, and cannot be exchanged for cash. Priority Access via referrals is granted at our sole discretion; referral fraud will result in removal from the program.
